Terms & Conditions for Nervous System Audio Download

    These Terms and Conditions (“Terms”) govern your purchase, download, and use of nervous system audio file(s) (“Audio”) provided by NerveAlign (“Business,” “we,” “us,” or “our”) via the website https://nervealign.systeme.io (“Site”).

    By purchasing, downloading, or accessing the Audio, you (“User” or “You”) agree to be bound by these Terms.


    1. Purchase and Access

    1. Upon successful purchase, the User will receive access to download the Audio via the Site.

    2. Lifetime Access: Access is provided for the lifetime of NerveAlign, meaning the continued operation of the Business. This does not guarantee access for the lifetime of the individual User. The Business may discontinue or remove access at any time at its sole discretion.

    3. NerveAlign is not responsible for loss of access due to User error or technical issues beyond its control.

    4. The Business reserves the right to modify the Audio content or format, provided such modifications do not materially diminish the overall purpose of the product.



    2. Intellectual Property

    1. All content, including the Audio, accompanying materials, text, graphics, and designs, remain the exclusive property of NerveAlign and are protected by copyright, trademark, and other applicable intellectual property laws.

    2. The User may:

      • Use the Audio for personal, non-commercial purposes only.

    3. The User may not:

      • Copy, distribute, share, or sell the Audio to others;

      • Modify, adapt, or create derivative works from the Audio;

      • Use the Audio for commercial purposes without express written permission from NerveAlign.



    3. Use Disclaimer

    1. The Audio is intended for personal development, relaxation, and nervous system regulation only.

    2. It is not a substitute for medical, psychological, mental health, or professional advice.

    3. Users with medical, psychological, or other health concerns should consult a qualified professional before using the Audio.

    4. Use of the Audio is at the User’s own risk. NerveAlign assumes no liability for any adverse effects, injury, or consequences resulting from use.


    4. Payments, Refunds, and Late Fees

    1. All prices are listed in AUD and include applicable taxes.

    2. Payments are processed securely via the Site.

    3. Due to the digital nature of the product, all sales are final, except where refunds are required under the Australian Consumer Law (ACL) for defective or misrepresented products.

    4. Refund requests must be made within 14 days of purchase and will be assessed in line with statutory consumer rights.


    5. Technical Access

    1. Users are responsible for their own devices, internet connection, and software to download and play the Audio.

    2. NerveAlign will make reasonable efforts to ensure download links are functional but is not responsible for technical issues outside its control.



    6. Limitation of Liability

    1. Participation and use of the Audio is voluntary; the User assumes full responsibility for their own physical, emotional, and mental wellbeing.

    2. To the maximum extent permitted by law:

      • NerveAlign is not liable for indirect, incidental, or consequential damages arising from use of the Audio;

      • Liability for breach of contract or negligence is limited to the purchase price of the Audio;

      • Nothing in these Terms excludes liability for death, personal injury, fraud, or other liabilities that cannot be excluded under Australian law.

    3. Users acknowledge that outcomes depend on their engagement, disclosure, and implementation of practices suggested in the Audio.

    7. Privacy

    1. NerveAlign collects personal information solely to process purchases and deliver access to the Audio.

    2. Personal information is handled in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

    3. NerveAlign will not sell or share personal data with third parties except as required to deliver services or by law.

    8. Governing Law and Jurisdiction

    1. These Terms are governed by the laws of Australia.

    2. The parties submit to the non-exclusive jurisdiction of courts in the state or territory in which NerveAlign operates.


    9. Amendments

    1. NerveAlign may amend these Terms at any time.

    2. Continued use of the Audio after amendments constitutes acceptance of the revised Terms.


    10. Acknowledgment

    By purchasing or downloading the Audio, the User acknowledges that they have read, understood, and agreed to these Terms.
